FACTS. - Mario Barber ran a classmates uninsured motorcycle into Bernards car. Farmers, as Bernards insurer, paid Bernards under the uninsured motorist provisions of his policy, then sued Mario under the subrogation provisions of Bernards policy. Marios father, Frank, also had insurance on his car through Farmers, but Farmers denied liability under Franks policy for damage by the motorcycle not owned by the insured.
